By creating an account, purchasing or accessing a product or service, enrolling on a course or submitting an application, you agree to these terms. If you are purchasing or using a service on behalf of an organisation, you confirm that you are authorised to act for that organisation.
Additional terms may be shown at checkout or contained in a quotation, proposal, order form, licence or award agreement. If there is a conflict, the specifically agreed written terms will take priority for that product or service.
Our services
Duty to Pause provides menopause-awareness education, professional resources and organisational recognition services.
Course descriptions, included materials, prices and access periods will be those displayed at the time of purchase or agreed in writing.
We may improve, update or replace course materials where this does not materially reduce the service purchased.
Educational purpose
Duty to Pause content is provided for education, awareness and professional development. It does not constitute medical, legal, employment, regulatory or clinical advice.
The training does not replace individual medical assessment, professional supervision, legal advice, safeguarding procedures or an organisation’s responsibility to comply with applicable law and professional standards.
You and your organisation remain responsible for decisions, policies, actions and professional practice arising from use of the materials.
Accounts and access
You must provide accurate and current information when creating an account.
You are responsible for:
• Keeping your login details confidential.
• All activity conducted through your account.
• Informing us promptly if you suspect unauthorised access.
• Ensuring that your use of the service complies with these terms.
Accounts and course places are personal to the authorised learner unless an organisational licence expressly provides otherwise. Login details must not be shared.
We may suspend access where we reasonably believe an account is being misused, shared without permission, used unlawfully or used in breach of these terms.
Organisational purchases
Where an organisation purchases training or services:
• The agreed number of places may only be used by its authorised learners.
• The organisation is responsible for providing accurate learner information and having a lawful basis for sharing it with us.
• The organisation must ensure that its learners comply with these terms.
• Additional users or uses may require an additional licence or fee.
• Access periods and transfer arrangements will be those stated in the applicable quotation, order or product description.
Purchase or completion of training does not automatically qualify an organisation for the Duty to Pause Award of Excellence.
Intellectual property
All course content, videos, text, graphics, branding, assessment materials, templates, downloads and other resources are owned by or licensed to Duty to Pause and are protected by intellectual-property law.
Subject to payment and compliance with these terms, you receive a limited, non-exclusive, non-transferable right to use the purchased materials for your own learning or your organisation’s authorised internal professional purposes.
Where a resource is supplied as an editable organisational template, you may adapt it for legitimate internal use.
You must not, without written permission:
• Copy, reproduce or distribute substantial parts of the course or resources.
• Share downloads outside the licensed organisation.
• Share, sell, sublicense or commercially exploit the materials.
• Record, download or reproduce course content except where a download is expressly provided.
• Remove logos, copyright notices or other ownership information.
• Use Duty to Pause branding in a way that suggests endorsement, accreditation or recognition that has not been awarded.
• Use the materials to create or deliver a competing course, product or service.
Learner and applicant submissions
You retain ownership of material you submit. You grant Duty to Pause a limited right to store, review and use that material only as reasonably necessary to provide the service, respond to you, assess work or administer an award application.
You must not submit material that:
• Is unlawful, defamatory, discriminatory or infringes another person’s rights.
• Contains confidential information you are not authorised to disclose.
• Identifies children, families, service users, patients, employees or other third parties unnecessarily.
• Contains special-category or sensitive personal information without an appropriate lawful basis and safeguards.
• Is misleading, fabricated or materially inaccurate.
Course examples and award evidence should be anonymised wherever possible.
Award of Excellence
The Duty to Pause Award of Excellence is an independent recognition programme operated by Duty to Pause. It is not a statutory accreditation, regulatory approval or guarantee of future organisational performance.
Submitting an enquiry, purchasing training or applying for assessment does not guarantee recognition or a particular award level.
Recognition is based on the criteria, evidence requirements and assessment process in force at the time of application. Additional award terms, fees, review periods and renewal requirements may be set out separately.
Applicants must provide accurate, authentic and lawfully obtained evidence. We may request clarification or further evidence.
Where recognition is awarded:
• The organisation may use the relevant award mark only for the stated recognition period and in accordance with any brand or usage guidance.
• The award mark must not be altered or used in a misleading way.
• Recognition must not be presented as applying to services, locations or organisations outside the assessed scope.
• Duty to Pause may list the organisation’s name, award level and recognition period in a public register where this forms part of the agreed programme.
We may suspend or withdraw recognition where evidence was materially inaccurate, the mark is misused, required standards are no longer maintained or continued association could reasonably mislead the public or damage the integrity of the programme. We will normally explain the concern and allow an appropriate opportunity to respond.
Prices and payment
Prices will be those displayed at checkout or stated in an agreed quotation or order.
Payment must be made using an available payment method. You are responsible for providing accurate billing information.
Where an organisation receives an invoice, payment is due within the period stated on that invoice. We may withhold or suspend access where payment is overdue, subject to applicable law and any written agreement.
Cancellations and refunds
Any cancellation or refund terms displayed at checkout or included in an agreed quotation, proposal or order will apply in addition to your statutory rights.
If you are purchasing as a consumer, you may have a legal right to cancel certain online purchases within 14 days. Different rules apply to digital content and services that begin during that period.
Where you request immediate access to digital content, you may be asked to expressly consent to supply beginning during the cancellation period and to acknowledge that your cancellation right will be lost once supply begins, as permitted by law.
Nothing in these terms limits any cancellation, refund, repair, replacement or other right that cannot lawfully be excluded.
Business and organisational purchases do not carry consumer cancellation rights. Any cancellation rights for those purchases will be those agreed in writing.
To request a cancellation or discuss a problem, contact [email protected].
Availability and technical requirements
We aim to provide reliable access but cannot guarantee that the website or platform will always be uninterrupted or error-free.
Access may occasionally be affected by maintenance, security work, internet problems or services outside our control. We will take reasonable steps to resolve material issues within our control.
You are responsible for having a suitable device, internet connection, supported browser and software needed to access the service.
Acceptable use
You must not:
• Use the website or services unlawfully or fraudulently.
• Attempt to gain unauthorised access to an account, system or content.
• Introduce malware or interfere with the security or operation of the service.
• Scrape, extract or systematically copy website or course content.
• Harass other users or misuse communication features.
• Misrepresent course completion, assessment results or award status.
Third-party services and links
Our services may use or link to third-party platforms, including Thinkific, email services and payment providers.
Third-party services may have their own terms and privacy policies. We are not responsible for unrelated third-party websites or for matters outside our reasonable control.
Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
Subject to the above, Duty to Pause is not responsible for:
• Decisions or actions taken without appropriate professional advice.
• Loss caused by inaccurate or incomplete information supplied by a user or organisation.
• Indirect or consequential loss.
• Loss of profit, business, opportunity, anticipated savings or reputation arising from business use.
• Failure or interruption caused by events or third-party services outside our reasonable control.
Where the law permits, our total liability relating to a paid product or service will not exceed the amount paid to Duty to Pause for that specific product or service during the 12 months preceding the event giving rise to the claim.
Termination
You may stop using the service at any time.
We may suspend or terminate access where:
• These terms are materially breached.
• Payment remains overdue.
• Access is shared or used outside the agreed licence.
• Use presents a security, legal or reputational risk.
• We are required to do so by law.
Termination does not affect rights or obligations that arose before termination. Provisions concerning intellectual property, confidentiality, liability and governing law will continue where appropriate.
Privacy
We process personal information in accordance with our Privacy Policy:
https://dutytopause.thinkific.com/pages/privacy
Changes to these terms
We may update these terms to reflect changes to our services, suppliers or legal obligations.
The updated version will be published on this page with a revised date. Material changes affecting an existing paid service will be communicated where reasonably necessary.
Governing law
These terms are governed by the laws of England and Wales.
If you are a consumer, you retain any mandatory protections and rights to bring proceedings available under the law that applies where you live.
For business and organisational customers, the courts of England and Wales will have exclusive jurisdiction unless otherwise agreed in writing.
